Terms of Service

These Terms of Service ("Terms") govern your use of the CardHabit iOS application, cardhabitapp.com, and the CardHabit waitlist (together, the "Service"). The Service is provided by Brandon Kessinger, a sole proprietor located in Phoenix, Arizona, USA ("CardHabit", "we", "us").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Acceptance
By creating an account, downloading the app, joining the waitlist, or otherwise using the Service, you accept these Terms and our Privacy Policy.
Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.
Your account
You are responsible for keeping your sign-in credentials secure. You are responsible for activity that occurs under your account. Notify us promptly at hello@cardhabitapp.com if you believe your account has been compromised.
Subscriptions
CardHabit offers a free tier with limited daily commits and vault size, and two paid auto-renewing subscription tiers:
- Pro — $7.99/month or $79.99/year
- Elite — $14.99/month or $149.99/year
Standard new subscriptions include a 7-day free trial. Founder pricing offered to waitlist members at launch is locked at signup and continues for as long as your subscription remains active and uninterrupted.
Auto-renewal
All subscriptions are billed through your Apple ID and renew automatically at the end of each period unless cancelled at least 24 hours before the end of the current period. You can manage or cancel at any time in Settings → [your name] → Subscriptions on your device. Deleting the app does not cancel your subscription.
Price changes
We may change subscription prices for future billing periods. Apple will notify you before any price change takes effect and may require you to confirm the new price.
Refunds
All refund requests are handled by Apple under the App Store refund process. To request a refund, visit reportaproblem.apple.com. We do not process refunds directly.
Your content
You retain ownership of the habit data, notes, and content you create in CardHabit. By using the Service, you grant us a limited license to host, store, sync, display, and process your content as needed to operate the app.
You are responsible for the content you submit. Do not submit content that is illegal, infringes someone else's rights, or violates these Terms.
Multiplayer features (Challenges and Buffs)
CardHabit lets you send and receive Challenge cards and Buff cards to and from friends you have explicitly connected with. By participating, you agree:
- You will not use Challenges to harass, intimidate, or harm anyone.
- The recipient may downgrade your friendship to "buffs only," disable Challenges entirely, or remove you as a friend at any time without notice.
- We may suspend Challenge and Buff features for any account that misuses them.
You may turn off multiplayer features for your account at any time in app settings.
Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the app, except where applicable law expressly permits.
- Use the Service to violate any law or another person's rights.
- Attempt to gain unauthorized access to our systems, other users' accounts, or our service providers.
- Use the Service to send spam, harassment, or unlawful content.
- Scrape, crawl, or otherwise programmatically access the Service in a way that disrupts it.
- Resell, sublicense, or commercially exploit the Service without our written permission.
We may suspend or terminate your account for violations of these Terms.
Intellectual property
The CardHabit name, logo, card art, card text, archetype designs, copy, fonts, and overall look and feel are owned by CardHabit and protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. Nothing in these Terms transfers any of our intellectual property to you.
Termination
You may stop using the Service at any time. You may delete your account from inside the app at Profile → Delete Account.
We may suspend or terminate your account if you violate these Terms, if your account is inactive for an extended period, or if we discontinue the Service. We will give reasonable notice when we can.
Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — survive termination.
Disclaimers
CardHabit is a productivity and self-improvement tool. It is not medical, mental health, fitness, nutrition, or professional advice. Do not use CardHabit in place of consulting a qualified professional. Listen to your body and judgment.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDHABIT AND ITS OPERATOR ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA, LOST PROFITS, OR LOST OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $50 USD.
Some jurisdictions do not allow these limitations; in those places, our liability is limited to the smallest amount permitted by law.
Indemnification
You agree to indemnify and hold CardHabit harmless from any claim or demand, including reasonable attorneys' fees, arising from your violation of these Terms, your content, or your use of the Service.
Governing law and disputes
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws principles. You and CardHabit agree that any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts. Nothing in this section restricts statutory consumer-protection rights you have in your country of residence.
Apple App Store terms
The CardHabit iOS app is licensed, not sold, to you. Your use of the app is also subject to Apple's standard end-user license agreement (the "Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent these Terms conflict with the Apple Standard EULA, the more restrictive terms (from your perspective) apply to your use of the app.
You acknowledge that these Terms are between you and CardHabit, not Apple, and that Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
Changes to these Terms
We may update these Terms as the product evolves. We will update the "Last updated" date above and, for material changes, notify you in app or by email. Continued use after changes take effect constitutes acceptance.
